Transcribenode ("we", "us", "the Service") provides AI-powered audio and video transcription. This policy explains what data we collect, how we use it, and your rights.

1. Who we are

2. What we collect

Email address.
Name (optional).
Password hash (never the plain password).
Billing info (last 4 digits of card, handled by payment processor).

2.2 Usage data

Files you upload for transcription.
Transcription output (text, SRT, VTT, DOCX).
Duration processed, model used, timestamps.
IP address, browser, device (for security and analytics).

2.3 Analytics

Self-hosted Umami analytics (no third-party tracking, no personal profiling).
Page views, time on page, referrers.

3. How we use your data

Provide the transcription service.
Bill you accurately (subscription or pay-as-you-go).
Support (answer your questions via email/WhatsApp).
Improve the service (aggregated, anonymized metrics only — never individual files).
Security (detect abuse, prevent fraud).

4. Critical: how we treat your uploaded files

4.1 Processing

Files are uploaded over TLS 1.3.
Processed on our GPU servers in temporary encrypted storage.
Transcript is generated and delivered back to you.

4.2 Retention

Files (audio/video): deleted within 24 hours after transcription completes.
Transcripts: kept in your account for 30 days (so you can re-download). You can delete them immediately via account settings.
Temporary processing logs: deleted within 7 days.

4.3 No training on your content

We do NOT use your files or transcripts to train models. Ever.
Model improvements come from aggregated metrics (e.g., average processing time per hour) — not content.

4.4 No human access

Automated system only. No employees listen to your audio or read your transcripts unless:
You explicitly request it (e.g., support ticket where you ask us to help diagnose).
Required by law (subpoena).

5. Payments

Processed by third-party providers (LemonSqueezy / Stripe).
We never store full card numbers.
Billing history (invoice record) kept for 7 years (legal requirement).

We do NOT sell or rent your data.

Data may be shared only with: - Infrastructure providers (hosting, CDN, payment) under strict confidentiality. - Legal authorities if required by a valid court order.

7. International transfers

Servers may be located in the EU or US.
Transfers are protected by Standard Contractual Clauses (SCCs) for EU users.
Argentina has been declared "adequate" for data transfer purposes.

8. Your rights

Under Argentine Law 25.326

Access, rectification, deletion, opposition, portability.

Right to be informed, access, rectification, erasure, restrict processing, data portability, object, rights related to automated decision-making.
Right to lodge a complaint with your local Data Protection Authority.

9. Cookies

Essential cookies: session, auth token (required for service).
Analytics cookies: self-hosted Umami (first-party, no profiling).
NO advertising cookies. NO third-party trackers.

TLS 1.3 for all connections.
AES-256 encryption at rest for files during processing.
Isolated GPU processing (per-request containers).
Monitoring for unauthorized access.
Incident response: breach notification within 72 hours per GDPR.

11. Children

Service not intended for users under 16. If you're under 16, please don't use Transcribenode.

12. Changes

Material changes notified by email 30 days in advance.
Non-material (clarifications) can be updated with 7 days notice.

📜 TERMS OF SERVICE

By using Transcribenode, you accept these terms.

1. The Service

Transcribenode provides: - AI transcription using Whisper-large-v3 on GPU infrastructure. - Export formats: TXT, SRT, VTT, DOCX, JSON. - Speaker diarization (pyannote). - 99+ language support (actively tested: EN, ES, PT, FR, DE, IT).

2. Account & eligibility

Must be 16 years or older (18+ if in countries that require it).
One person or legal entity per account.
Provide accurate registration info.

3. Plans & pricing

3.1 Free tier

First file free (up to 20 minutes).
No signup required for first file.

3.2 Paid plans

Pay-as-you-go: USD 0.10 / minute processed.
Starter: USD 9/month for up to 10 hours.
Pro: USD 29/month for up to 40 hours.
Business: USD 99/month for up to 200 hours.
Volume discount (100+ hours/month): custom pricing.

3.3 Billing

Subscriptions billed monthly or annually (annual: 20% discount).
PAYG balances charged upfront via LemonSqueezy/Stripe.
All prices in USD, exclusive of applicable taxes.

3.4 Refunds

First 14 days of new subscription: full refund on request.
PAYG balance: partial refund of unused amount if you close your account.

4. Acceptable use

You will NOT: - Upload content you don't have rights to transcribe (copyright, privacy violations). - Upload illegal content (child abuse material, violent extremism, etc.). - Attempt to reverse engineer or abuse the service. - Use the service for automated resale (unless you have a partnership agreement). - Upload files larger than 500MB or longer than 2 hours (hard technical limits).

Violation: immediate suspension + no refund.

5. Your content

You own your content. Uploading doesn't transfer ownership to us.
You grant us a limited license to process your content for the sole purpose of delivering the service.
This license terminates immediately upon file deletion (within 24h post-processing).

6. Availability

Target uptime: 99% monthly.
Occasional maintenance windows announced 48h in advance.
Downtime > 2% in a calendar month → credit equal to 5% of monthly subscription.

7. Disclaimers

7.1 AI accuracy

Whisper accuracy is typically 92-98% on clean audio, 80-92% on noisy/accented.
We don't guarantee specific accuracy percentages.
Always review transcripts before publication or critical decisions.

7.2 No fitness for specific purpose

Transcribenode is NOT certified for:
Legal depositions requiring certified transcription.
Medical documentation requiring HIPAA compliance.
Court-admissible transcripts.
For those uses, hire a certified transcriptionist.

8. Intellectual property

Our IP: Transcribenode software, brand, UI, marketing.
Your IP: your files and the resulting transcripts.
Open source: some components (Whisper, pyannote) under their respective licenses.

9. Liability limitation

Our maximum liability: the amount you paid us in the 12 months preceding the incident.
We're NOT liable for: indirect damages, lost profits, business interruption, data loss.
Exception: gross negligence or willful misconduct on our part.

10. Termination

You: can cancel anytime from account settings.
Us: can terminate with 30 days notice for any reason, immediately for terms violation.
Upon termination: files deleted, transcripts archived 30 days then deleted.

11. Changes to the Service

We may modify, suspend, or discontinue features with reasonable notice. Material removal of paid features → prorated refund.

12. Dispute resolution

Informal first: email us, we try to resolve in 30 days.
Arbitration: disputes unresolved informally go to arbitration under ICC rules.
Courts: if arbitration fails, Buenos Aires courts, Argentina.

13. Governing law

Argentine law, with respect to consumer protection laws of your jurisdiction where applicable.

14. Miscellaneous

Entire agreement: these Terms + Privacy Policy supersede prior understandings.
Severability: invalid clauses don't void the rest.
No waiver: not enforcing a right doesn't waive it.
Assignment: we can assign the service to an acquirer with notice.
